Are You Eligible For An Expungement?

In the past decade, more and more states are making expungement an accessible option for people with criminal history. This has made access to housing, work and other services much easier for many people, especially those with a limited criminal record. Do you or a loved one has a criminal record? Expungement may be a good option for you.

Understanding Oklahoma Expungement Law

Expungements can be complicated and depend on many different factors. In Oklahoma, there are two types of expungement. These are referred to as Section 18 expungement and Section 991(c) expungement.

Section 18 expungements apply to your complete arrest record. In contrast, Section 991(c) expungements are for deferred or dismissed arrests. An expungement request is needed in each county on your record.

Filing for expungement requires extensive paperwork and legal notice. While you can choose to petition for your expungement on your own, it is highly advisable that you hire an attorney. The state can file an objection with the court about your expungement request. A lawyer can also help you navigate the legal system and help you account for all eligible expungements.

Please note, Oklahoma's expungement statutes go into effect beginning Nov. 1, 2018.
